Hukuk normlar\u0131 hem toplumsal normlar nazara al\u0131narak kaleme al\u0131n\u0131r, hem de toplumsal a\u00e7\u0131dan bir ideal ortaya koyma \u00e7abas\u0131 g\u00fcder. Toplu olarak ya\u015faman\u0131n temel kavramlar\u0131ndan diyebilece\u011fimiz ki\u015filik, evlenme, velayet, miras gibi m\u00fcesseseleri d\u00fczenleyen T\u00fcrk Medeni Kanunu, 149. maddesinde yan\u0131lma sebebiyle evlili\u011fin ortadan kald\u0131r\u0131lmas\u0131n\u0131 d\u00fczenlemi\u015ftir. Bu madde uyar\u0131nca:<\/p>\n<blockquote><p>\u201cA\u015fa\u011f\u0131daki durumlarda e\u015flerden biri evlenmenin iptalini dava edebilir:<br \/>\n1. Evlenmeyi hi\u00e7 istemedi\u011fi veya evlendi\u011fi ki\u015fiyle evlenmeyi d\u00fc\u015f\u00fcnmedi\u011fi h\u00e2lde yan\u0131larak bu<br \/>\nevlenmeye raz\u0131 olmu\u015fsa,<br \/>\n2. E\u015finde bulunmamas\u0131 onunla birlikte ya\u015famay\u0131 kendisi i\u00e7in \u00e7ekilmez bir duruma sokacak<br \/>\nderecede \u00f6nemli bir nitelikte yan\u0131larak evlenmi\u015fse.\u201d<\/p><\/blockquote>\n<p>\u0130lk f\u0131kra esasen \u00e7ok net; <strong>tam bir Ye\u015fil\u00e7am filmi senaryosu:<\/strong> kad\u0131n duva\u011f\u0131n\u0131 bir a\u00e7ar gelin koltu\u011funda me\u011fer ba\u015fka bir kad\u0131n oturmaktaym\u0131\u015f, damat \u015fok olur, bu konu \u00fczerinde tart\u0131\u015f\u0131lacak pek bir detay yok, malum, evlilik feshedilebilir. Fakat ikinci f\u0131kra tamamen yoruma a\u00e7\u0131k, hangi hallerde uygulanabilece\u011fi hakimin takdirine b\u0131rak\u0131lm\u0131\u015f bir durumda&#8230; Birka\u00e7 mahkeme karar\u0131 de\u011ferlendirildi\u011finde hukuk kurallar\u0131 ve bu kurallar\u0131n uygulay\u0131c\u0131lar\u0131 bak\u0131m\u0131ndan kad\u0131na evlilik kurumu i\u00e7inde bi\u00e7ilen rol belirgin \u015fekilde ortaya \u00e7\u0131kmaktad\u0131r.<\/p>\n<p>Yarg\u0131tay\u2019\u0131n 2012\u2019de verdi\u011fi bir kararda kad\u0131n\u0131n yumurtal\u0131k rezervinin azalmakta oldu\u011funu (premat\u00fcre over yetmezli\u011fi te\u015fhisi konmu\u015f olmas\u0131) kocas\u0131ndan saklamas\u0131 sebebiyle kocan\u0131n a\u00e7t\u0131\u011f\u0131 davada mahkeme tabi ki kocay\u0131 hakl\u0131 bulur, evlili\u011fin ba\u015ftan itibaren h\u00fck\u00fcms\u00fcz k\u0131l\u0131nmas\u0131 gerekti\u011fine h\u00fckmeder. Bu konuya gerek\u00e7e olarak da davac\u0131 e\u015fin \u00e7ocu\u011funun olmamas\u0131 ihtimalinin zaten evlili\u011fin temel amac\u0131na ayk\u0131r\u0131 oldu\u011funu \u00f6ne s\u00fcrer. Bu demek oluyor ki <strong>Yarg\u0131tay nezdinde insanlar \u00e7ocuk yapmak i\u00e7in evlenir, \u00e7ocuk yapamad\u0131\u011f\u0131n s\u00fcrece evlenmen bir anlamda \u201ch\u00fck\u00fcms\u00fcz\u201dd\u00fcr.<\/strong> Buradaki \u00f6nemli noktalardan biri e\u015flerden birinin kendi sa\u011fl\u0131k durumu konusunda di\u011fer e\u015fi aldatm\u0131\u015f olmas\u0131 neticesinde bo\u015fanma talep edilmesi de\u011fil, evlili\u011fin ba\u015ftan itibaren h\u00fck\u00fcms\u00fcz k\u0131l\u0131nmas\u0131 durumudur. (Y.2.HD. 28.11.2012, 8975\/28250)<\/p>\n<p>Kanunun uygulay\u0131c\u0131lar\u0131, kad\u0131n\u0131n evlenmeden \u00f6nce bakire olmas\u0131na y\u00fcklenen anlama da olduk\u00e7a hak verir ve bu bekaret bilgisinin ger\u00e7e\u011fe ayk\u0131r\u0131 verilmesini evlili\u011fin h\u00fck\u00fcms\u00fcz k\u0131l\u0131nmas\u0131na gerek\u00e7e kabul eder. Yarg\u0131tay\u2019\u0131n 2007\u2019de verdi\u011fi bir kararda a\u00e7\u0131k\u00e7a \u201cdaval\u0131 kad\u0131n\u0131n zifaf gecesi bakire \u00e7\u0131kmamas\u0131 (\u2026) kad\u0131nda bulunmas\u0131 laz\u0131m gelen vasf\u0131n bulunmamas\u0131 sebebiyle kocan\u0131n davas\u0131n\u0131n kabul\u00fc\u201d ifadesiyle ortaya koymu\u015ftur. <strong>Kad\u0131nda bulunmas\u0131 laz\u0131m gelen vas\u0131f evlenmeden \u00f6nce bakire olmas\u0131d\u0131r ve bu hususta kocay\u0131 yan\u0131ltt\u0131ysa bu evlili\u011fin h\u00fck\u00fcms\u00fcz k\u0131l\u0131nmas\u0131 gerekir.<\/strong> (Y.2.HD. 22.02.2007, 14649\/2504) Bu y\u00f6nde Yarg\u0131tay Hukuk Genel Kurulu taraf\u0131ndan verilmi\u015f bir\u00e7ok ba\u015fka karar da mevcuttur.<\/p>\n<p>Ayn\u0131 Yarg\u0131tay erke\u011fin cinsel ge\u00e7mi\u015fi bak\u0131m\u0131ndan b\u00f6yle bir \u201cvasf\u0131n\u201d bulunmas\u0131n\u0131 tabii ki \u00f6ng\u00f6rmez. Bunun t\u0131bben tespiti kad\u0131nda oldu\u011fu kadar kolay olmasa da kimi varsay\u0131mlardan yola \u00e7\u0131kmak pek tabi m\u00fcmk\u00fcnd\u00fcr. \u00d6rne\u011fin 2010\u2019da Yarg\u0131tay\u2019\u0131n ayn\u0131 hukuk dairesi taraf\u0131ndan verilen bir karar\u0131nda daval\u0131 erke\u011fin evlenmeden \u00f6nce iki y\u0131ldan beri bir ba\u015fka kad\u0131nla fiilen beraber ya\u015f\u0131yor olmas\u0131n\u0131n evlili\u011fin feshedilmesi (Medeni Kanunun 149. maddesi) kapsam\u0131nda de\u011ferlendirilemeyece\u011fine h\u00fckmetmi\u015ftir. (Y.2.HD. 07.10.2008, 13176\/12702)<\/p>\n<p>\u00d6te yandan \u201cerk\u201d dedi\u011fimiz kavram erkekli\u011fe de kimi k\u0131l\u0131flar dikmi\u015ftir. <strong>Erkek olman\u0131n bir gere\u011fi \u201ciktidar\u201d kelimesiyle \u00f6zde\u015fle\u015ftirilen tam cinsel birle\u015fmenin ger\u00e7ekle\u015ftirilebilmesidir.<\/strong> Yarg\u0131tay cinsel iktidars\u0131zl\u0131\u011f\u0131 evlili\u011fin feshine karar verilmesi gereken bir neden olarak g\u00f6r\u00fcr. (YHGK. 29.06.1994, 2-329\/477) Yarg\u0131tay\u2019\u0131n ayn\u0131 y\u00f6nde g\u00fcncel kararlar\u0131na da rastlamak m\u00fcmk\u00fcn.<\/p>\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere kanun e\u015flerin birbirleri hakk\u0131nda \u201cyan\u0131lm\u0131\u015f\u201d olmalar\u0131n\u0131 kimi hallerde evlili\u011fin ba\u015ftan itibaren hi\u00e7 do\u011fmam\u0131\u015f olmas\u0131 ile sonu\u00e7land\u0131r\u0131r. Peki neden bo\u015fanma gibi bir imkan varken b\u00f6yle ilave bir d\u00fczenlemeye ihtiya\u00e7 duyulmu\u015ftur? Elbette ki mal ayr\u0131l\u0131\u011f\u0131, nafaka gibi di\u011fer hususlara dair h\u00fck\u00fcm kurulmas\u0131 gerekmeksizin ki\u015finin \u201cbekar\u201d medeni haline geri d\u00f6nd\u00fc\u011f\u00fc bir d\u00fczenleme oldu\u011fundan&#8230; Dolay\u0131s\u0131yla bo\u015fanma yerine feshe gidebilmek i\u00e7in bu \u201cyan\u0131lma\u201dn\u0131n \u00e7ok esasl\u0131 olmas\u0131 gerekir.
